GENERAL POLICIES

All of us at Winstanley-Roark Fine Arts strive to insure you will be find just the right work of art for your needs and that will be happy with your art purchase. We have placed our policies here so you will have a clear understanding of what our policies are. If you have any questions about our policies please feel free to contact us so we may review them with you and assuage any concerns about your art purchase.

PURCHASING ORIGINAL ART FROM OUR INTERNET SITE

Each work of art is a unique creation. With that in mind we would like to personally contact you to ensure that you are happy with your purchase and to verify you receive exactly what you want.

If you can not visit us here on Cape Cod, and have seen a work of art here on our Internet gallery site that you would like to purchase, then we request you call toll free 1-866-385-4713 to speak to either Anita Winstanley Roark or Robert Roark directly. If you'd rather we welcome you to e-mail us at wrfa@masterfulart.com directly or you might like to use our Purchase Form to contact us. We will mail or telephone you with the requested information within the next 48 hours.

We have listed our policies to try to answer many of the most commonly asked questions about purchasing art from us from our online site. We hope you find this helpful but if you can't find the answer to your questions, please, don't hesitate to contact us.

INTERNET TEN (10) DAY BUSINESS RETURN POLICY

To ensure you are happy with your purchase of an original work of art we offer you, our customers, ten (10) business days to receive and review your purchase of an original work of art from our Internet site. To receive a refund from this type of purchase we require that the art and frame are returned to the gallery within ten (10) business days from the day it was shipped from the gallery. For example, if we shipped on Monday the 1st, then it must be returned to the gallery by Friday the 12th at closing, or no refunds will be issued. Internet purchases do require payment for the full amount of the art work plus all packing/shipping/insurance costs. Customers are responsible for all packing/ shipping/insurance costs from and to the gallery. All art and its frame must be returned in its original good condition or no refunds will be issued. If art/frame is returned on time and in its original good condition then we will be happy to issue a full refund for the amount of the original art purchase.

RETURNS & REFUNDS FOR INTERNET LITHOGRAPH PURCHASES

If for some reason the limited edition lithograph that you purchased online is not what you expected you may return it in its original good condition and in the original packaging for a full refund for the cost of the framed/unframed lithograph within two (2) weeks (14 days) of the purchase date. All framed/unframed limited edition offset lithographs must be returned to the gallery insured for the full amount. All packing/shipping/insurance from and to the gallery is the responsibility of the customer and is not included in this refund policy.

NOTE: This return policy applies only to framed/unframed limited edition lithographs purchased online. Because you would have had the option to view the work and condition of the art in person, we do not make refunds on limited edition lithographs purchased from our gallery location

RETURNS & REFUNDS OF ORIGINAL ART PURCHASED FROM OUR BRICK AND MORTAR GALLERY LOCATION

Purchasing art is not like purchasing regular retail items. Each work of art requires a great deal of invested time and creative energy by the artist. With this in mind, all sales on original art are final and we do not make refunds on any original works of art sold from our gallery location. We will be happy to review a work of art and its condition with a customer but it is the sole responsibility of the customer when purchasing art to know their own tastes and to verify the condition of the art. We do our best to review all aspects about an art purchase with our customers; however, in the end, it is up to the customer to ascertain that the art work is correctly sized, properly framed, has the correct colors, etc. for their needs. We understand that purchasing art requires great care. Therefore, to insure the customer is purchasing exactly what is wanted, we have established the following viewing options before the art purchase is made:

PREVIEWING OF ART

Winstanley-Roark Fine Arts is happy to supply interested customers with photographs and information about a piece of art before purchase to help with any concerns. If you live in the Cape Cod, MA area, we will be happy to let you preview the work of art privately in your home for 48 hours. This type of private previewing does require a refundable deposit for the full amount of the work of art being previewed. If for some reason the customer decides this work is not as expected, the customer, upon returning the art work in the same good condition as when it left the gallery and returned before closing of the gallery during this 48 hour period will receive his/her full deposit. Unless previously arranged, if the art work is not returned before the closing of the gallery during this 48 hour period or if the art work is damaged in any way it will be agreed by all parties involved that the customer is keeping the art work and all refunds and deposits will be void.

For any private previews we require that our Preview Agreement be signed and returned to the gallery before shipping or previewing can take place. This agreement states that you agree to the above mention policy.

If a local customer prefers, they may arrange an appointment for one of us at the gallery to bring the an original work of art to their house for a personal viewing.

PACKING, SHIPPING & INSURANCE

All packing/shipping/insurance costs are the responsibility of the customer. All shipping and packaging insurance is done through a licensed packaging and shipping company. We are not responsible for any damage or breakage to art because of shipping, handling or packaging as this is the sole responsibility of the packing company and the customer. Please contact the packaging and shipping company with shipping or handling problems or damage. All invoices, shipping information and costs will be supplied with shipped art.

All unframed limited edition lithographs will be shipped within 24 hours and framed limited edition lithographs within one (1) to three (3) weeks from the time the order is received. The only exception to this is if you have personally requested a rush order at an additional charge, or if there is an unavoidable delay, in which case, we will notify you ASAP with a new shipping date.

GUARANTEE

We do guarantee that the framing will be as described and that all limited edition offset lithographs/original works of art are done by the artist named and/or executed in the manner described. Upon your request, for your personal or insurance needs, we are happy to supply letters of current value for offset lithographs/original works of art.

FRAMING

We offer our customers the option of changing a frame for a like frame of same value on any original work of art to suit personal needs if so requested.

Framing of ilfochromes and color photographic prints, works of art on paper, and offset lithographs are framed using 100% acid-free double mats. The glass/Plexiglas is 97% UV to protect the art from light damage. The art is museum mounted using 100% conservation material. Frames, selected to enhance the art are lined and backed with barrier paper to protect the art from acid damage. All this is done to ensure that your ilfochromes and color photographic prints, works of art on paper, and offset lithographs will have a long a life and retain its current value.

Most all original works of art are framed in wood or wood frames, which are hand gilded in gold metal leaf. Upon your request we will be happy to send you a picture of the art with frames, please call our toll free number, 1.866.385.4713.

DEPOSITS AND LAYAWAYS

Winstanley-Roark Fine Arts does offer an interest-free payment and a layaway plan for original works of art. Please contact the gallery for further information or to establish your payment or layaway plan at 1.866.385.4713.

Please note that all deposits for purchases and all layaway payments are nonrefundable.

COMMISSION BY ROBERT K. ROARK

Mr. Roark, through Winstanley-Roark Fine Arts, does accept commissions for original works of art or portraits. All commissions are based on the current value of Mr. Roark's other works of art and he does not charge any additional charges for commissions. Commission are paid for in a three step plan. A one third deposit is required to start a commission. Mr. Roark then does a small, to scale oil sketch of the commission. Mr. Roark proceeds with the commission once the approved sketch is returned to him along with the next one third payment. The final one third payment is required upon completion of the commission. Mr. Roark has established this easy and simple method to eliminate any guess work and to insure that the customer is receiving exactly the right image, colors, and size that the customer had in mind. Mr. Roark does guarantee that the finished work of art will be done to the previously agreed to subject, colors, and scale as were in the sketch of the commission. All commissions include framing. Sketches are not included in the price of the commission and all payments are nonrefundable. Most commissions are completed within two to three months but this may vary upon time of year and the order in which the commission was received in.
